1. Introduction and acceptance
These Terms of Service, including the End User License Agreement for our mobile application, are an agreement between you and Odeon Apps, LLC (“Company,” “we,” or “us”). By accessing or using the Duck Hunt website, mobile application (“App”), or related services, you agree to these terms. If you do not agree, do not use the services.
You must be at least 13 years old to use Duck Hunt. If you are below the age of majority where you live, your parent or legal guardian must agree to these terms.
2. Accounts and acceptable use
You are responsible for providing accurate account information, protecting your credentials, and activity under your account. Do not use Duck Hunt for unlawful activity, harassment, impersonation, infringement, or sharing content you do not have permission to share. Do not interfere with the service, bypass access controls, or attempt to access another person’s private information.
3. Scope of license
The App is licensed, not sold. Subject to these terms, we grant you a limited, non-exclusive, non-transferable license to use Duck Hunt for your personal use. For the iOS App, this license permits use on Apple-branded products you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions, including applicable Family Sharing or volume purchasing provisions.
4. Your content and privacy
You retain ownership of the photos, hunt logs, comments, and other content you submit. You grant us permission to store, process, reproduce, and display that content as needed to operate the service and apply your sharing choices. You are responsible for your content and for obtaining any necessary permissions from others featured in it.
Public content may be viewed and saved by others. We may remove content or restrict accounts that violate these terms. Our Privacy Policy explains how we handle personal information.
5. Hunting and outdoor safety
Duck Hunt is a logging and sharing service. It does not provide permission to hunt, enter property, or use firearms. You are responsible for complying with hunting seasons, licenses, bag limits, land access rules, and other applicable laws, and for following safe firearm, boating, and outdoor practices.
Maps, locations, species information, and user posts may be incomplete or inaccurate. Verify conditions, boundaries, and regulations independently. Do not use the App in a way that distracts you from safely handling equipment or navigating the outdoors. To the extent permitted by law, Odeon Apps, LLC is not responsible for injury or property damage resulting from your outdoor activities or unsafe use of the App.
6. Purchases and subscriptions
If paid features or subscriptions are offered, prices, billing periods, and trial terms will be shown before purchase. Purchases made through Apple are billed to your Apple ID account and are subject to Apple’s payment and refund terms. Auto-renewing subscriptions continue until canceled; manage or cancel them in your App Store account settings before the renewal deadline shown at purchase. Deleting your Duck Hunt account or uninstalling the App does not cancel an App Store subscription.
7. Apple and support
This agreement is between you and Odeon Apps, LLC, not Apple Inc. Odeon Apps, LLC is responsible for the App and its content, and for any applicable maintenance and support. Apple has no obligation to provide maintenance or support services for the App.
8. Warranties and limitations
To the extent permitted by law, the services are provided “as is” and “as available,” without a guarantee of uninterrupted operation, accuracy, or suitability for a particular purpose. Nothing in these terms excludes warranties, remedies, or liability that cannot lawfully be excluded.
If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the App’s purchase price where applicable. To the maximum extent permitted by law, Apple has no other warranty obligation; Odeon Apps, LLC is responsible for other applicable warranty claims.
9. Product claims and intellectual property
Odeon Apps, LLC, not Apple, is responsible for addressing claims relating to the App, including product liability, legal or regulatory compliance, privacy, and consumer protection claims. If a third party claims the App or your use of it infringes intellectual property rights, Odeon Apps, LLC, not Apple, is responsible for investigating, defending, settling, and discharging that claim as required by law.
10. Legal compliance and third-party services
You agree to comply with applicable laws and relevant third-party terms when using the services. You represent that you are not located in a country subject to a U.S. Government embargo or designated as supporting terrorism, and are not on a U.S. Government list of prohibited or restricted parties.
11. Termination and changes
You may stop using the services at any time. We may suspend or terminate access for violations of these terms or to protect the service and its users. We may change or discontinue features and update these terms. Updated terms will be posted here with a revised date, and we will provide additional notice when required by law.
12. Third-party beneficiaries
For the iOS App, Apple and its subsidiaries are third-party beneficiaries of this agreement. Upon your acceptance, Apple has the right to enforce the applicable provisions of this agreement against you as a third-party beneficiary.
